American Thom Mayne snags Pritzker architecture prize

Longtime Los Angeles architect Thom Mayne was awarded this year’s Pritzker Architecture Prize. Established in 1979 to honor “consistent and significant contributions to humanity,” the prize is considered by many to be the highest honor in the field. The award includes a bronze medallion and US$100,000. Mayne was the first American to receive it in 14 years; previous American recipients include Robert Venturi (1991) and Frank Gehry (1989).

Mayne earned his architecture degree from the University of Southern California in 1968. A few years later he founded his own architecture school, the Southern California Institute of Architecture, which remains to this day. He then moved to Los Angeles, where in addition to running a firm, Morphosis, he teaches architecture at UCLA.

Mayne’s earlier work, considered “angry” and “brooding”, was outside of the architectural mainstream. His style was often called bold and audacious. This style has recently become more accepted, as Morphosis won contracts to design government buildings in California, Oregon, and Washington, DC. The firm also designed an Olympic village in Queens, in preparation for the city’s 2012 Olympics bid.

On receiving the prize, Mayne said, “This is such a big deal….it is not in my nature to think about being the one who prevails. For my whole life, I’ve always seen myself as an outsider.”

NY Sen. Monserrate found guilty of misdemeanor assault

New York State Senator Hiram Monserrate was found guilty of misdemeanor assault Thursday, in the criminal trial involving an alleged attack on his girlfriend Karla Giraldo. Monserrate will face sentencing on the misdemeanor assault conviction on December 4.

Monserrate had also faced charges of felony assault, but he was not convicted of these charges. The misdemeanor assault conviction means Monserrate is guilty of “recklessly causing physical injury” to Giraldo. Monserrate could be sentenced to one year in jail for the misdemeanor assault conviction.

The prosecution had asserted that when Monserrate discovered that his girlfriend had the business card of another man, he chose to strike out at her. Monserrate entered a plea of not guilty to charges he sliced his girlfriend’s face with broken glass during a conflict at their apartment on December 19, 2008. The defense team denied that the injury to the woman by Monserrate was intentional, instead claiming that the incident was “an accident” and the result of Monserrate tripping while bringing Giraldo a glass of water.

A police detective that first investigated the crime scene testified about the bloody evidence discovered at Monserrate’s apartment, including broken glass, blood, towels covered in blood, and a ripped women’s t-shirt. Forensic biologist Ewilina Badja said that the majority of the blood found at the crime scene had originated from one woman. Prosecutors asserted that this woman is Giraldo, who was treated for injuries surrounding her left eye that took approximately 40 stitches to remedy. Badja identified blood on a male green shirt found in the bathroom sink as that of Monserrate.

An emergency physician that had treated Giraldo stated in court that Monserrate’s girlfriend asserted to her that her injuries were not the result of an accident. Though the defense has argued that Giraldo, who is from Ecuador, may have been difficult to understand – the physician stated she conversed with Monserrate’s girlfriend in both Spanish and in English.

Whether or not the public is going to stand for somebody who has been convicted of a criminal act…

Queens Supreme Court Justice William Erlbaum judged the case without a jury, as Monserrate waived his right for a trial before his peers. The group National Organization for Women had requested that the judge rule Monserrate should be given “the maximum sentence allowable by law”. If he had been convicted of a felony, Democrat Sen. Monserrate could have automatically lost his New York State Senate seat. Monserrate did not testify during the criminal trial against him.

There are no winners here today.

WXXI reported that Patricia Salkin of the Government Law Center at Albany Law School, said state Senators may be faced with political issues if they do not do something about Monserrate’s continued presence as a Senator. Salkin stated that the issue was: “Whether or not the public is going to stand for somebody who has been convicted of a criminal act, and act of domestic violence in this case, to be allowed to continue.” According to WXXI, Senate rules do not state that a misdemeanor conviction means a politician must be removed from office, it is within the power of the New York Senate to initiate procedures to oust a sitting Senator. WXXI reported that leaders within the Democratic party in the New York Senate were debating whether to being proceedings to remove Monserrate from his seat. WNYC reported that the Senators are deciding whether or not to initiate disciplinary proceedings against Monserrate.

There is no room in government or in the Democratic Party for people who commit such heinous crimes against women. Hiram Monserrate must be swiftly removed from office.

The New York Daily News reported that Monserrate gave a statement outside the courthouse after the ruling, and continued to describe the injury to Giraldo’s face as a “terrible accident”. He referred to Giraldo as “”a person who I love”. Monserrate stated that: “I have to live with that forever. There are no winners here today.” Monserrate’s attorney, Joseph Tacopina, believed that his client would not serve any jail time. “On a reckless misdemeanor, first offense, he won’t go to jail,” said Tacopina.

New York City Council member Eric Gioia was the first Democratic politician to publicly request that Monserrate resign from his post as a member of the New York State Senate. Gioia released a statement which said: “There is no room in government or in the Democratic Party for people who commit such heinous crimes against women. Hiram Monserrate must be swiftly removed from office. Elected officials should rightfully be held to a higher standard, and New Yorkers deserve better representation than a convicted perpetrator of domestic violence.” Gioia stated that “the circumstances revealed in the trial … truly shock the conscience.”

Monserrate is a former New York City police officer. Prior to becoming a member of the New York State Senate, he was a city councilman. He became a member of the New York State Senate weeks after the alleged conflict with Giraldo, and was made chair of the committee overseeing consumer affairs. Along with Democrat Pedro Espada Jr., Monserrate started a shift in control of the Senate by aligning with the Republican Party. Monserrate is currently allied with the Democrats in the New York Senate, and if he is removed from his seat the ratio of Democrats to Republicans would be 31-30.

Japanese tsunami impacts California coastal town

The tsunami caused by Japan’s magnitude 8.9 quake on Friday destroyed the commercial fishing harbor of Crescent City, California, a coastal town still recovering from a devastating tsunami in 1964. Although most of the fishing boats were removed in advance, the 198 docking slips that the harbor had provided for boats, enabling the livelihoods of the fishing crews, were lost.

Harbormaster Richard Young said that the harbor is destroyed. “We’re facing not only physical but financial disaster,” he said during a briefing. “Our business activity came to a screeching halt yesterday, and that affects the entire community.” Councilwoman Kelly Schellong said, “This is going to have a trickle-down effect beyond the lost jobs.”

Crescent City’s unemployment rate was 13 percent before Friday’s tsunami destroyed its commerical fishing industry.

The 1964 tsunami that hit Crescent City killed 11, demolished the harbor and heavily damaged large portions of the business district. Although the city subsequently rebuilt, another tsunami again damaged the harbor in 2006. The city was in the midst of reconstructing the harbor when Friday’s tsunami hit. The harbor is surrounded by land and a breakwater built after the 1964 disaster. The tsunami’s huge waves entered through a small opening provided for the entrance and exit of boats.

Lori Dengler, director of the Humboldt Earthquake Education Center, says Friday’s tsunami was one of as many as 38 tsunamis to strike Crescent City within the last 78 years. She calls the city a “tsunami magnet” because of the topography of the ocean floor that contributes to its vulnerability. She also blames the breakwater built after the 1964 tsunami because it traps tsunami waves in the harbor, causing them to boil and churn.

A county supervisor found the view painful on Saturday as she surveyed the wreckage accompanied by state officials. She is hoping they will provide emergency assistance. “We don’t have the financial resources,” she said. “We need money. That’s what it takes to fix things…. Our poor little harbor.”

U.S. President Obama’s farewell address focuses on accomplishment

United States President Barack Obama gave his official farewell address on Tuesday night from McCormick Place in Chicago, reflecting on personal and national accomplishments. This is expected to be his last major speech before officially handing the reins to president-elect Donald Trump on January 20.

“Its why GIs gave their lives at Omaha Beach and Iwo Jima; Iraq and Afghanistan – and why men and women from Selma to Stonewall were prepared to give theirs as well.”

Obama’s speech was wide-ranging. He thanked his family and the nation, spoke of the need for unity, noted the country’s accomplishments and need for improvement in areas like education and civil rights, and spoke about the need for pride in U.S. accomplishments, citing milestones of U.S. history and of his presidency specifically. “It’s why GIs gave their lives at Omaha Beach and Iwo Jima; Iraq and Afghanistan – and why men and women from Selma to Stonewall were prepared to give theirs as well.”

The president also addressed his country’s troubled history with race and racism, an issue many black citizens feel he has avoided. Despite this, Chauncy Devega of Salon described the president as “a role model of calm, cool reflective black masculinity: a man utterly at home in his own skin.” Obama described the concept of a post-racial U.S. “unrealistic” and particularly cited the need for reform in education and the criminal justice system and greater acceptance of scientific evidence, particularly evidence supporting action to counteract climate change.

However, publications including The Washington Post and Salon have given particular focus to another aspect of the president’s address: the country’s increasing political tensions and controversies involving access to news and information, both accurate and inaccurate. “We become so secure and our bubbles,” said Obama, “that we start accepting only information, whether it’s true or not, that fits our opinions instead of basing our opinions on the evidence that is out there,” calling this trend “a third threat to our democracy.”

The Washington Post characterized Obama’s comment, “If every economic issue is framed as a struggle between a hard-working white middle class and an undeserving minority, then workers of all shades will be left fighting for scraps while the wealthy withdraw further into their private enclaves,” as a “not-so-subtle jab” at the campaign tactics of President-elect Donald Trump. The Telegraph describes Obama’s warnings about the need to protect democracy as “a thinly veiled slight to the divisive rhetoric of Donald Trump’s election campaign, which included attacks on Muslims, the disabled, women and immigrants.” The president went on to call on the public to “reject the first dawning of every attempt to alienate any portion of our country from the rest or to enfeeble the sacred ties that make us one America. We weaken those ties when we allow our political dialogue to become so corrosive […] We weaken those ties when we define some of us as more American than others when we write off the whole system as inevitably corrupt and when we sit back and blame the leaders we elect without examining our own role in electing them. It falls to each of us to be those anxious, jealous guardians of our democracy.”

Despite this, when the mention of Donald Trump brought boos from the crowd, Obama reiterated the importance of the long history of peaceful transfers of power from one president to the next: “No no no no no. […] I committed to President-elect Trump that my administration would ensure the smoothest possible transition, just as President Bush did for me.” However, this was not unaccompanied by a call to action. Near the end of the speech, he insisted citizens dissatisfied with elected officials should “lace up your shoes, grab a clipboard, get some signatures and run for office yourself.”

Overall, the departing president’s speech focused on accomplishment, echoing the “Yes we can” slogan from his 2008 campaign: “If I have told you eight years ago, that America would reverse a great recession, reboot our auto industry, and unleash the longest stretch of job creation in our history. If I had told you, that we would open up a new chapter with the Cuban people, shut down Iran’s nuclear weapons program without firing a shot, take out the mastermind of 9/11[…] If I had told you that we would win a marriage equality and secure the right to health insurance for another twenty million of our fellow citizens. If I had told you all that, you might have said our sights were set a little too high. But that’s what we did.”

But when the crowd began shouting “Four more years! Four more years!” Obama, with a small laugh, answered, “I can’t do that.”

Pfizer and Microsoft team up against Viagra spam

New York –”Buy cheap Viagra through us – no prescription required!” Anyone with an active email account will recognize lines like this one. According to some reports, unsolicited advertisements (spam) for Viagra and similar drugs account for one in four spam messages.

BACKGROUND

Spamming remains one of the biggest problems facing email users today. While users and systems administrators have improved their defenses against unsolicited email, many spammers now insert random words or characters into their letters in order to bypass filters. The Wikipedia article Stopping email abuse provides an overview of the various strategies employed by companies, Internet users and systems administrators to deal with the issue.

Ever since pharmaceutical giant Pfizer promised to cure erectile dysfunction once and for all with its blue pills containing the drug sildenafil citrate, spammers have tried to tap into male anxiety by offering prescription-free sales of unapproved “generic” Viagra and clones such as Cialis soft tabs. Legislation like the U.S. CAN-SPAM act has done little to stem the tide of email advertising the products.

Now Pfizer has entered a pledge with Microsoft Corporation, the world’s largest software company, to address the problem. The joint effort will focus on lawsuits against spammers as well as the companies they advertise. “Pfizer is joining with Microsoft on these actions as part of our shared pledge to reduce the sale of these products and to fight the senders of unsolicited e-mail that overwhelms people’s inboxes,” said Jeff Kindler, executive vice president at Pfizer.

Microsoft has filed civil actions against spammers advertising the websites CanadianPharmacy and E-Pharmacy Direct. Pfizer has filed lawsuits against the two companies, and has taken actions against websites which use the word “Viagra” in their domain names. Sales of controlled drugs from Canadian pharmacies to the United States are illegal, but most drugs sold in Canada have nevertheless undergone testing by the U.S. Food and Drug Administration. This is not the case for many of the Viagra clones sold by Internet companies and manufactured in countries like China and India. While it was not clear that CanadianPharmacy was actually shipping drugs from Canada, Pfizer’s general counsel, Beth Levine, claimed that the company filled orders using a call center in Montreal, reported the Toronto Star.

For Microsoft’s part, they allege that the joint effort with Pfizer is part of their “multi-pronged attack on the barrage of spam.” As the creator of the popular email program Outlook, Microsoft has been criticized in the past for the product’s spam filtering process. Recently, Microsoft added anti-spam measures to its popular Exchange server. Exchange 2003 now includes support for accessing so-called real-time block lists, or RTBLs. An RTBL is a list of the IP addresses maintained by a third party; the addresses on the list are those of mailservers thought to have sent spam recently. Exchange 2003 can query the list for each message it receives.

EU to investigate secret CIA establishments in Romania, Poland

The European Union, the Council of Europe and the Red Cross said Thursday they will investigate allegations by Human Rights Watch that the CIA has set up secret jails in Romania and Poland.

Mark Garlasco, senior military analyst with Human Rights Watch discovered the secret prisons by examining flight logs of CIA aircraft.

Garlasco, who is a former civilian intelligence officer with the Defense Intelligence Agency, told The Associated Press, “The indications are that prisoners in Afghanistan are being (taken) to facilities in Europe and other countries in the world.”
